We guarantee that your website will be functional as well as aesthetically pleasing. During the beginning stages of your website design project, we will provide mock-ups and screenshots for THE CLIENT to choose from. Each mock-up will be considered as a style direction. After THE CLIENT has chosen a style direction, we will proceed with that particular style. It is the responsibility of THE CLIENT to communicate to Webhosting and Beyond, LLC what is desired in terms of styling. If the client is unsure we can either make a suggestion on the style direction or we can produce a custom website design style. All custom designs will be charged at an hourly rate. While the look and feel of a website is important, our primary endeavor is to make sure that the website funcions as described by THE CLIENT prior to the start of the website design project. It is our view that functionality and usability of the website should be the highest priority. We also feel that it is our responsibility to SUPPORT THE CLIENT and provide guidance on the best practices for usability and functionality of the website. At times there may be disagreements and requests to proceed in a new direction. We are happy to accommodate THE CLIENT'S wishes, but requiring substantial changes to a website project after work has begun will be viewed as a change request. Change requests will most likely generate new fees that will be charged at an hourly rate. The rate will depend on the type of change requested.
We will never share your information with third parties unless unless necessary in the coarse of developing your website or are required to do so by law or explicitly requested by you. The information we collect from you will be used to maintain your services with us. Webhosting and Beyond, LLC does reserve the right to showcase your website in our portfolio for promotional purposes.
OWNERSHIP OF WEBSITE DESIGN
Upon completion of a custom website design and payment of web design and development fees, THE CLIENT is the owner of the commissioned website. The client may continue to use the commissioned website to promote THE CLIENT's company or organization regardless of whether he/she chooses to continue further services with Webhosting and Beyond, LLC. The client does not have the right to resell the design or development to other companies. The client does have the right to add pages onto the existing site or have another company add pages onto the existing site using the commissioned website design/development.
OWNERSHIP OF WEBSITE DOMAIN NAME
Website domain names are leased from domain name registration companies. When Webhosting and Beyond, LLC registers a domain name for a client, that registration will be made in THE CLIENT's name. Upon payment of any outstanding fees, THE CLIENT has the right to use that domain name regardless of whether he/she chooses to continue further services with Webhosting and Beyond, LLC. Domain name renewal and renewal fees are the responsibility of THE CLIENT. If THE CLIENT chooses to have Webhosting and Beyond, LLC renew the domain name on behalf of THE CLIENT, an additional service fee will apply. Clients are advised to closely monitor the renewal date of a registered domain name and to verify that the renewal of said domain name has been completed. Webhosting and Beyond, LLC cannot be responsible for expired domain names.
OWNERSHIP AND COPYRIGHT
All text and photos used as content in a commissioned website must be provided by THE CLIENT (unless THE CLIENT has hired Webhosting and Beyond, LLC for content development). The client must have ownership or written permission to use all content he/she provides for use. It is up to each client to ensure his/her design and/or content does not infringe on any trademark, service mark, or copyright. Webhosting and Beyond, LLC cannot be responsible for intellectual property infringements on behalf of clients. Also, Webhosting and Beyond, LLC cannot be responsible for submitted content. Clients should not mail irreplaceable photos or documents or send content that must be returned.
The initiation of a web design or development project requires a deposit of 50% of the web design/development estimated fees. Your initial deposit of 50% or any lesser or greater amount constitutes THE CLIENT'S acceptance and agreement with our policies, terms of service, and website development agreement.
PROJECT DELAY PENALTIES
Webhosting and Beyond, LLC cannot complete a website if THE CLIENT does not provide content (the text and/or photos to be used in the website) or other required elements (pre-existing logo or account login information, etc.). If Webhosting and Beyond, LLC is waiting for content or other pieces of information, THE CLIENT will be notified via email. If THE CLIENT fails to provide the requested information within 7 business days, the website projected completion date will be delayed. (Professional writing and photography services are available for a surcharge if THE CLIENT needs assistance with content development.) If THE CLIENT has not submitted all content and other required elements within 30 days of project initiation, all work will cease and THE CLIENT will be billed $50 per month for every month the project is delayed up to 6 MONTHS. After 6 MONTHS, Webhosting and Beyond, LLC reserves the right terminate the project and delete the website, databases, and all assets from our servers.
HOW TO SUBMIT ASSETS
All content, also referred to as ASSETS, must be submitted electronically via the ticketing system. Assets are any text, images, photos, and graphics that will be used on the website. To access the ticketing system, THE CLIENT must login and submit a support ticket. If the client has possession of a CD containing assets, it can be mailed to Webhosting and Beyond, LLC at 976 Siesta Key Blvd #316, Deerfield Beach, FL 33441. Please DO NOT mail originals. These assets WILL NOT be returned. Assets must be clearly labeled with a descriptive name. Please include specific instructions in the support ticket describing what page(s) the assets are to be used on.
DESIGNS AND LAYOUTS FOR INTERNAL PAGES
An internal page is defined as any page other than the home page. Unless otherwise stated, the internal pages will use the same design as the home page. If THE CLIENT requires a specific layout or design for an internal page(s), this request should be made prior to the initial deposit. If THE CLIENT determines that after the project has begun a new page layout and/or design is needed for an internal page(s) this will be considered a change request and will incur an additional charge(s).
HOW TO MAKE MAINTENANCE REQUESTS
Clients who have signed up for a maintenance plan receive discounts off the web designer's hourly rates for website updates. Clients on a Webhosting and Beyond, LLC web maintenance plan may send update requests via the support ticket system. Routine maintenance which fits into the allotted time specified in THE CLIENT's maintenance plan is typically completed in about three to four business days. If a client who has subscribed to a website maintenance plan requests more than the scheduled amount of maintenance, THE CLIENT will be given a quote and, if approved, the additional work will be completed at a discounted rate of $50.00 per hour, and the turn-around time will be based on workload issues. Clients who are not on any maintenance plan may request website updates at the full $60.00 hourly rate and the turnaround time will be based on workload issues. Monthly maintenance plan fees are separate from hosting fees and may be cancelled at any time. (See details under the Termination of Services section)
HOW TECHNICAL SUPPORT IS HANDLED
Clients who choose to host with Webhosting and Beyond, LLC may also have access to technical support via the support ticket system. In the event of a technical difficulty, THE CLIENT must submit a support ticket through our support ticket system. If this difficulty occurs during the holiday season or after hours, THE CLIENT can send ONE SHORT TEXT MESSAGE to alert us of the problem. Text messages DO NOT constitute or equate to a support ticket. THE CLIENT MUST ALSO submit a support ticket with the details of the problem. The ticket MUST include a link to the problem page. THE CLIENT must include a detailed description of the problem. Stating that something isn't working is insufficient. THE CLIENT must explain step by step what THE CLIENT was doing and attempting to do at the time the problem occurred. We must be able to duplicate the problem in order to diagnose and fix the problem. If it is determined that a technical problem was not created by Webhosting and Beyond, LLC or an official representative thereof, a fee may me assessed.
One-half of the initial website design and development fees are due upon project initiation. Upon project completion, the remaining balance is due in full within five business days. Once the remaining balance is paid in full, the completed website will go live on servers hosted by either Webhosting and Beyond, LL or by THE CLIENT'S hosting company of choice. Payment for monthly services such as Hosting, Maintenance, SEO and/or marketing are due within net 30. Webhosting and Beyond, LLC charges a late fee of 15% of the outstanding balance for invoices not paid within 30 days. Accounts at net 60 are at risk of termination, including the suspension of a website or the removal of a website from the server, resulting in a loss of website traffic and a drop in search engine ranking. Clients experiencing financial hardship should contact Webhosting and Beyond, LLC to discuss payment options.
TERMINATION OF SERVICES
THE CLIENT must immediately notify Webhosting and Beyond, LLC upon discovery of any billing discrepancy. If it is determined that THE CLIENT was charged an amount less than the correct amount for services rendered while no discount was in effect, THE CLIENT is responsible for paying the difference. Webhosting and Beyond, LLC reserves the right to bill clients for accidental undercharges. If it is determind that THE CLIENT overpaid for services rendered, Webhosting and Beyond, LLC will provide THE CLIENT a credit towards future payments or a cash refund payable within 60 to 90 days. Refunds of over payments will be made for up to a maximum of three months, so clients are urged to check billing statements regularly. THE CLIENT has 90 days to request a refund on services rendered. After 90 days refund requests will not be processed. This policy DOES NOT apply to website design and development.
THIRD PARTY VENDOR DISPUTES
During the course of website development, it may be determined that a third party plugin, extension, or addon is necessary. Third party vendors may have separate terms of service agreements. Webhosting and Beyond, LLC cannot be held liable for disputes with third party vendors. Webhosting and Beyond, LLC cannot be held responsible for lack of functionality or any other aspect of third party services. Webhosting and Beyond, LLC will be an advocate for THE CLIENT to resolve any third party vendor disputes.
RIGHT OF REFUSAL OF SERVICE
Webhosting and Beyond, LLC reserves the right to decline to do business with any client for any reason.
CHANGES TO TERMS OF SERVICE
Webhosting and Beyond, LLC reserves the right to change these terms of service at any time for any reason.
